(“Manatee Labs,” “we,” “our” or “us”) collects, uses, stores, shares and protects personal information when you use our software as a service platform, related websites and services (together, the “Service”). By accessing or using the Service you agree to the collection and use of information in accordance with this Notice.

2. Information We Collect

2.1 Account Information

  • Email address
  • Password hash and password reset tokens
  • Display name or alias

2.2 User Content

  • Documents, images or other files you upload
  • Custom text-based instructions that you provide for how you want a video to be generated
  • Videos that the Service generates from your uploads
  • Feedback signals such as thumbs up, thumbs down and written comments

2.3 Usage and Device Data

  • Log files, IP address, browser type and settings
  • Date and time stamps, crash data, cookies, pixels and similar technology
  • Approximate location inferred from your IP address

2.4 Payment Information

If you purchase a paid tier we collect billing details such as cardholder name, card information, billing address and tax identifiers which are processed by our payment processor on our behalf.

2.5 Information from Third Parties

We may receive information from analytics providers, advertisers or affiliates.

3. How We Use Information

We use personal information to:

  • Operate, maintain and improve the Service, including training and tuning machine learning models
  • Generate videos and other output you request
  • Provide customer support and respond to inquiries
  • Monitor and enforce compliance with our Terms of Service
  • Conduct research, analytics, testing and product development
  • Send transactional messages and, where allowed, promotional messages
  • Detect, investigate and prevent fraud, security incidents and other harmful activity
  • Comply with applicable law and protect our legal rights

4. Legal Bases for Processing (EEA, UK and Similar Jurisdictions)

We process personal information on the following bases:

  • Performance of a contract with you
  • Our legitimate interests, including improving and marketing the Service, securing the Service and enforcing our agreements
  • Compliance with legal obligations
  • Your consent, where we request it

  • With subsidiaries, joint venture partners, successors or acquirers

6. Your Content License

You grant Manatee Labs a worldwide, perpetual, irrevocable, non exclusive, royalty free, fully paid, transferable and sublicensable right to use, reproduce, host, store, adapt, translate, create derivative works from, publicly perform, publicly display and otherwise exploit User Content and the resulting videos for any business purpose, including commercial sale, advertising, model training and improvement, benchmarking and publication. This license survives termination of your account and deletion of User Content. You waive any moral rights or similar rights in and to User Content to the fullest extent permitted by law.

7. Cookies and Tracking Technology

We use first party and third party cookies, local storage, pixels and similar tools to recognize your browser, improve the Service, remember preferences, measure performance and deliver relevant advertising. You can control cookies through your browser settings. Disabling cookies may reduce Service functionality.

8. International Transfers

We are based in the United States and your information may be processed and stored in the United States and other countries that may not provide the same level of data protection as your jurisdiction. Where required we rely on approved transfer mechanisms such as Standard Contractual Clauses or any replacement framework that becomes available.

9. Data Retention

We retain personal information for as long as necessary to deliver the Service, fulfill the purposes set out in this Notice, comply with legal obligations and resolve disputes. Aggregated or de identified information may be kept indefinitely.

10. Your Rights

Depending on your location you may have rights to access, correct, delete, port or restrict the processing of your personal information, object to certain processing and lodge a complaint with a supervisory authority. To exercise these rights, contact us using the details in Section 14. We may require verification of your identity before responding.

11. Security

We implement administrative, technical and physical safeguards designed to protect personal information. No security measure is perfect. We do not guarantee absolute security of your data.

12. Children’s Privacy

The Service is not directed to children under thirteen years of age. We do not knowingly collect personal information from children under thirteen. If you believe that a child has provided personal information to us, contact us and we will delete the information.

13. Changes to This Notice

We may update this Notice from time to time. The “Last updated” date at the top shows when the latest changes were posted. Your continued use of the Service after any update constitutes acceptance of the updated Notice.
